A new, provisional sailing speed record, in fact two records, have been set by the French foiler, l'Hydoptere sailing/flying off Hyeres, France overnight. The new 500 metre mark has been lifted to over 51kts and during the run, she hit a top speed of 55kts.

We have a brief report in this issue plus photos from the record attempt.

No significant news on the America's Cup front - save for a commentary piece which looks at the confidential agreement between the International Sailing Federation and Societe Nautique de Geneve. The latter claims that there is nothing unusual in the agreement, and that the New York Court agreed with them on that point. However that view was not shared by BMW Oracle Racing team boss, Larry Ellison, who saw the agreement - after the Court had given it the big tick.

There's another commentary from Eric Sharp, of the Detroit Free Press, a veteran US sailing and America's Cup writer - giving his always 'must read' view of the state of the America's Cup.

In the commentary we look at what could be in the document, based on the thrust of the affidavits lodged late last week by Golden gate YC, the club of BMW Oracle Racing.

From the same affidavits, we are sure that BOR90 measures in over the 90ft Load Waterline Length, using the rules published in early August by SNG. So clearly there are some tense times ahead in the America's Cup legal saga. No papers have yet been filed in respect of the venue in Ras al Khamiah, however they are expected in a few weeks.
